総論
私的利用目的の複製が起因となり、著作権保護作品が幅広く利用されることになるが、それはすなわち著作権保護作品を創作することにより生計を立てている者にとって多大な損失を意味する。個人が複製をするという可能性から直接利益を得ているのは、輸入業者、製造業者、流通業者なのだから、私的複製に適した製品の輸入あるいは製造について、輸入業者あるいは製造業者が私的複製補償金を支払うのは妥当である。また複製するコンテンツがなければ、機器の製造量や販売量は大幅に少なくなっていたであろうことを心に留めることが重要である。
DRMについて言えば、現在の傾向はDRMシステムから何ら保護措置もないシステムへ移行していると言える。なぜなら後者の方がより消費者にとって使い勝手が良いからである。
しかし仮にDRMが広範に使われていたとしても、現在権利者はDRMから直接何ら支払いを受けていないのだから、私的複製補償金制度の必要性は依然としてあると議論することが可能である。更に仮にDRMから権利者への直接の支払いがあったとしても、そのことをDRM対応のディバイスの補償金額へ反映させるべきかについては明確でない。なぜならそのようなディバイスはDRM付でないものを複製することも可能だからである。
またDRMは現在音楽と映画の販売についてのみ使われていることを指摘することは重要である。テレビやラジオ番組などDRMにより保護されていないものについても、複製は可能である。

The copying for private use results in a wide exploitation of protected works and translates into substantial losses for those who earn their living by creating such protected works. Since it is the importers, manufacturers and distributors that directly profits from the possibility for individuals to make copies it is also reasonable that importers or manufacturers should pay a private copying levy on their import or manufacture of products especially suitable for private copying. It is also important to bear in mind that without any content to copy the volumes of manufactured and sold equipment and media would be far less.
Regarding the DRM argument it can be mentioned that the current trend is a shift from DRM systems to systems without any protection measures since such systems are much more consumer friendly. However one can also argue that, even if DRMs were to be used in a larger extent, there is still a need for a private copying levy system since right holders currently do not receive any payment directly through DRMs for private copying. It is also important to mention that even if such payment should exist it is not clear that this should affect the levy on DRM-compatible devices. Such devices can also be used to copy non DRM material. It is also important to point out that DRM systems presently only are used in connection with sales of music and films. Copying can also be made of other material such as TV- and radio-programmes
etc. which is not DRM protected.
