社団法人 電子情報技術産業協会 | 中間まとめに述べられている通り、いわゆる「カラオケ法理」の適用には、過度な拡張が見受けられ、著作物の利用に多少でも関わる事業の遂行において、予見可能性の点から大きな問題が生じているものと考えられます。したがって、司法判断における過度な拡張を謙抑的にする、間接侵害規定の立法が望まれます。「まとめ」(76ページ)にあるように、第112条所定の差止請求の対象となる「侵害」につき、「一定の要件を満たす他者の行為もこれに該当することを、法律上明確化する」ことは、総論としてよいとしても、「一定の要件」をいかなるものとすべきかにつき、利用と保護のバランスに配慮することを条件に、「慎重に検討を進める」とする中間まとめの立場に賛同します。 |
社団法人日本図書館協会 | 私的録音録画小委員会において「違法配信事業者から入手した著作物の録音録画物からの私的録音録画」についての審議が行われているが,いわゆる「カラオケ法理」により,複製行為者が実際に複製機器を操作した者ではなく,複製機器の設置者であると認定されるという前提に立てば,図書館や公民館あるいはネットカフェ等の,端末を設置し情報が提供される場で,利用者や来店者が「違法配信事業者から入手した著作物の録音録画物からの私的録音録画」を行ったとしても,当該複製行為の行為者は図書館や公民館あるいはネットカフェ等ということになる。 当該複製行為の位置付けについても,例えば著作権法30条1項に基づく「私的使用のための複製」とし,その複製行為者が図書館や公民館あるいはネットカフェ等であるとするならば,組織・団体が「私的使用のための複製」を行っていることになり,法運用上,種々の問題が生じると思われる。また,当該複製行為に使用されるパーソナルコンピュータ等の端末は,著作権法30条1項1号にいう「公衆の使用に供することを目的として設置されている自動複製機器」に該当すると考えられるが,附則5条の2にいう「専ら文書又は図画の複製に供するもの」に該当するかは疑問であり,複製行為者を利用者や来店者とした場合であっても,著作権法30条1項に基づく複製とすることには無理があると考えられる。 さらに,図書館に限定して考えた場合,著作権法31条の「図書館等における複製」の権利制限規定があるが,インターネット情報は同条の「図書館資料」には該当しないことから,当該複製行為の位置付けを著作権法31条に基づくものとすることにも無理がある。 これらのことから,今や,流通する情報の中で重要な位置をしめるインターネット上の情報の提供に支障をきたしている状況であり,「間接侵害」の検討に関しては,上記のような問題を念頭に置きつつ検討願いたい。 |
日本民主主義著作者総連合 | 著作権法は他の知的財産法と比べても、「間接侵害」について必ずしも保護に厚くなく、判例においても「カラオケ法理」の採用など、法解釈論的に無理を重ねている。保護される法益は価値のあるものであり、立法化に向けて検討していること、また「『管理支配』の内容自体が多義的であり、例えば直接行為者の自由意思をどの程度拘束する場合が含まれるのか、また物の提供による侵害が含まれるかどうかなどが不明確ではないか」(75ページ)との指摘が出る等、非常に慎重に検討している点について、賛意と敬意を表したい。 しかし創作者として気になるのは、やはり、差止請求対象として想定される範囲が過剰に広範になってしまい、創作活動の萎縮を招くのではないかということである。 間接侵害に係る一例としての立法案を見るに、「専ら侵害の用に供される物等の提供その他の行為により他者に(侵害)行為をさせることにより侵害をする者」について、「その行為により、他者の侵害行為をそのコントロール下に置いており、(その行為をやめること等により)この他者の侵害行為を除去し、ないし、生じさせないことができる立場にある者のことであるといえる」と示されている。この文面を読むと、例えばいわゆる同人誌の即売会のなかで、主として「パロディー」作品を提供する即売会の運営者が該当してしまうように思われる。非オリジナルの同人誌をどのように評価しているか、明らかでないため、気になるところである。 このような事例をどう評価するか検討していただきたいと願うと同時に、現在のいわゆる「萌え」文化の隆盛を見るに、こうした文化を一意に違法化してはならないと思われる。もちろん創作者本人に許諾を得ている場合もあるだろうし、そうでなくても黙示の許諾は得ているかもしれない。しかし、この分野は経済規模と比して非常にセンシティブかつグレーな文化であり、またそうであるからこそ、ここまで発展してきたとも言える。 先述したように、知識労働者は、創作者であると同時に利用者であるとも言える。 われわれは既に流布している創作物を、時として風刺し、倣って学び、新たなる創作物として昇華させることが多くある。その際対象となるのは、古典的な創作物に留まるというわけではない。時事的な流行や同時代の著作物を利用することも多い。以上のような意図的な利用を保護することも、文化の発展や多様性を考えると必要であると考えており、民著総連としては、「同人文化」を比較的肯定的に捉えている点は明言しておきたい。 |

ニフティ株式会社 | 司法判断における「カラオケ法理」の適用には、過度な拡張が見受けられる。そのため、弊社のようなインターネットサービスの提供者が、利用者等による著作物の利用により、(物理的に)利用行為をなす者ではないのにもかかわらず著作権侵害の主体とされ、サービスを差止められるリスクの予見可能性が低く、大きな問題である。 したがって、「カラオケ法理」の過度な拡張を抑制するような「間接侵害」立法であれば、賛成する。 立法の際、「まとめ」(p76)にあるように、第112条の差止請求の対象となる「侵害」行為に、「一定の要件を満たす他者の行為もこれに該当することを、法律上明確化する」する手法をとるのであれば、「一定の要件」をいかなるものとすべきかにつき、民法の物件的請求権等の基本理論との整合性に配慮し「慎重に検討を進める」ことについては賛同するが、これまで「カラオケ法理」が差止請求に適用された事例(p73〜74)等について無批判に整合性をとることが無いようにされたい。 |

日本知的財産協会 | いわゆる「カラオケ法理」の過度な拡張は予測可能性を欠き、実務上弊害を生じるおそれがあるため、間接侵害について、著作権法上何らかの規定をおくべきであるとの趣旨に賛同する。 但し、著作物等の利用態様はさまざまであり、利用行為の類型化が困難であることから、過去の判例の検討にとどまらず、現状及び将来予測される利用態様も念頭におきつつ、慎重に検討したうえで制度設計を行っていただきたい。また、間接侵害規定は権利者及び利用者の双方にとって影響が大きいものであり、具体的要件が明確となった段階で改めて意見募集の機会を設けていただきたい。 |
IFPA & RIAA | INDIRECT INFRINGEMENT OF COPYRIGHTS AND INJUNCTIVE RELIEF(p. 71-76, Section 6) We strongly support the proposal that the law should be clarified to ensure that injunctions may be issued in cases of indirect liability. In order to effectively prevent ongoing infringement, injunctive relief (both preliminary and permanent) must be available against indirect infringers. subject of course to the usual judicial discretion to respond to the particular circumstances of the case. This is particularly critical in the online environment, where services built on the unauthorised dissemination of music files deliberately induce and facilitate mass infringement. The only effective way to stop the haemorrhaging of valuable content is to enjoin the ongoing service.either to shut it down or to condition its continuation on appropriate preventative measures such as filtering. We also note that the lack of clearly authorised injunctive relief in the law is anomalous internationally. The standard approach in other countries is to have injunctive relief available for any act of infringement, whether direct or indirect. In fact, we are not aware of any other country which does not provide for injunctive relief against indirect infringers, and have not experienced any difficulties in obtaining such relief elsewhere. It is likewise essential that Japan adopt legislation that provides for the ability to obtain injunctive relief against a service that provides access to infringing materials, regardless of where the infringing materials are stored, and without regard to whether the access provider may otherwise be liable as an indirect infringer. This is particularly important where the infringing materials are stored outside of the jurisdiction of a Japanese court, and where obtaining prompt injunctive relief may be the only mechanism by which access to unauthorised materials may be prevented. We therefore submit that it would be appropriate and timely for Japan to clarify its law to provide for injunctive relief in cases of indirect liability. STATUTORY DAMAGES(p. 71-76, Section 6) The Interim Report states that: “Regarding the statutory damage and other mechanisms that help the copyright holders counting the number of infringements or amount of damage, the subcommittee concluded this issue should be reviewed cautiously since the discussions have not been reached consensus as to whether the copyright law should have a special system, which civil law and other IP laws do not have.” We hope that future discussions will lead to the establishment of a concensus to join the many nations around the world that provide for a system of statutory or exemplary damages. Statutory damages are designed both to provide stronger deterrents against copyright infringement and to better compensate copyright owners for losses suffered because of infringement. They ease the evidentiary burden on the plaintiff in proceedings for infringement, provide greater certainty and predictability, deter future infringements, reduce the cost of litigation and encourage the parties to settle matters out of court. The problem is that damages in copyright cases can be extremely difficult to prove in court. A copyright owner who commences proceedings for infringement must prove not only the infringement, but also the losses suffered as a result, and calculating damages can be a challenging process. In many civil law jurisdictions, the only damages that can be paid are those related to the specific infringing act that has been specifically pled and proven before the court. In order to prove the harm, the rightsholder must produce expert witnesses and/or other proof, such as documents, licenses, witnesses, etc. These items may be difficult to obtain or produce, and delay resolution of the case. Because the extent of infringement can be difficult to prove, copyright owners are often inadequately compensated for losses suffered as a result of infringement of their rights. This discourages them from bringing enforcement actions and, in effect, acts as an incentive to infringement and promotes an attitude that payment of damages is a tolerable cost of doing business for an infringer. As a result, many countries have adopted an alternative method of calculating damages: namely, providing for a set amount of money (or a sum within a pre-set range) to be paid for each infringing act or with respect to each infringed work (or other protected subject matter such as a phonogram or performance). Such a statutory damages system produces some important benefits:
