Administration Regulations for the National Research and Development Agency Council under the Ministry of Education,Culture,Sports,Science and Technology(MEXT)

Under the provisions of Article 9 of the Cabinet Order for the National Research and Development Agency Council under MEXT(Cabinet Order No.193 of 2015),the Administration Regulations for the National Research and Development Agency Council under MEXT shall be provided as follows:

(Purpose)
Article 1 The procedures of proceedings and necessary matters for the National Research and Development Agency Council(hereinafter referred to as the “Council”),in addition to what is provided for in Cabinet Order for the National Research and Development Agency Council of MEXT(hereinafter referred to as the “Order”),shall be provided by these regulations.

(Calling of a Meeting)
Article 2 The meeting of the Council shall be called by the chairperson,when it finds necessary.

(Resolution in Writing)
Article 3(1)When the chairperson cannot hold a meeting due to an unavoidable reason,the chairperson shall serve the documents that state the summary of a draft to the committee members and the temporary members concerned with the matters,collect their opinions or ask for pros and cons,and can make the results of this a resolution of the Council.
(2)If such resolutions are made pursuant to the preceding paragraph,the chairperson shall report them in the next meeting.

(Exception of Resolution Rights)
Article 4(1)The officials of the Agency,who are committee members or temporary members concerned with the proceedings,shall have no resolution rights for all or part of opinions concerning evaluation of the Agency(however,the officials,who have a close relationship with the Agency through contract research,have resolution rights,and those who have been employed by competitive funds have no resolution rights).
(2)Pursuant to the separate provisions of the Council,persons who are committee members and temporary members concerned with the proceedings,and who have an interest in the Agency,shall have no resolution rights for all or part of opinions concerned with evaluation of the Agency.  

(Sub-Committee)
Article 5(1)The name of the sub-committee and affairs under jurisdiction shall be provided by the chairperson through a discussion in the Council.
(2)The meeting of the sub-committee shall be called by the chairperson of the sub-committee,when it finds necessary.
(3)The members of a sub-committee can attend meetings of other sub-committees and state opinions,when it finds necessary.
(4)Pursuant to the provisions of Article 5(6)of the Order,items provided in the Council in advance shall be determined by the sub-committee subsequently and then become the resolutions of the Council.
(5)When the sub-committee passes a resolution regarding to the items prescribed in the preceding paragraph,the chairperson of the sub-committee shall promptly report the contents of the resolution to the chairperson of the Council.
(6)In addition to what is provided for in each of the proceeding paragraphs,the procedure for the sub-committee and other necessary matters concerning the administration of the sub-committee shall be determined by the chairperson of the sub-committee,in consultation with the sub-committee.

(Committee)
Article 6 (1) Council may, pursuant to these Regulations, establish a Committee to examine a certain matter flexibly.
(2) Members, temporary members and expert members (hereinafter referred to as “Committee Members, etc.”) comprising the Committee shall be appointed by the chairperson of the Council.
(3) General manager shall be appointed from the Committee Members, etc. by chairperson of the Council.
(4) General manager shall control the affairs of the Committee.
(5) General manager shall call a meeting of the Council.
(6) In the general manager is unable to attend to his or her duties, a member designated by the general manager from the Committee Members, etc. in advance shall perform the duties of the general manager on his or her behalf.
(7) General manager shall report a progress and results of an examination conducted by the Committee to the Council.
(8) In addition to what is provided for each of the preceding paragraphs, procedures for the Committee meetings and other necessary matters concerning the administration of the Committee shall be determined by the general manager in consultation with the Committee.

(Opening of a Meeting)
Article 7(1)Council meetings shall be open.This shall not apply to the following:the election of a chairperson and matters on personnel;matters on evaluation of the Agency’s performance of management;when the Council recognizes that a closed meeting is appropriate because the matters may affect a smooth discussion.
(2)The procedures of Council open meetings and other matters necessary for an open meeting shall be provided by the chairperson through a discussion in the Council.

(Miscellaneous Provisions)
Article 8 In addition to what is provided for in the regulations,the procedures of the Council’s proceedings and other matters necessary for the Council’s management shall be provided by the chairperson of the Council through a discussion in the Council.

Supplementary Provisions
The regulations shall come into effect as from the date of the decision made by the Council (May 15,2015).

The regulations shall come into effect as from the date of the decision made by the Council (February 7, 2019).
