Cabinet Order for the National Research and Development Agency Council of Ministry of Education，Culture，Sports，Science and Technology
（Cabinet Order No．193 of April 10，2015）

The Cabinet hereby establishes this Cabinet Order pursuant to the provisions of Article 8 of the National Government Organization Act（Act No．120 of 1948）．

（Organization）
Article 1（1）The National Research and Development Agency Council of Ministry of Education，Culture，Sports，Science and Technology（hereinafter referred to as the “Council”）shall be organized by a Committee with up to twenty（20）members．
 （2）The Council may include temporary members when it is necessary to investigate and deliberate special matters．
 （3）The Council may include expert members when it is necessary to investigate and deliberate professional matters．

（Appointment of Committee Members）
Article 2（1）Committee members shall be appointed by the Minister of Education，Culture，Sports，Science and Technology from among persons with relevant knowledge and experience（or，where applicable，from among Foreign Nationals（referring to those who do not have Japanese nationality；hereinafter the same in this Article）with in-depth knowledge and experience of research and development，pursuant to the provisions of paragraph（3）of Article 2 of the Act on General Rules for Incorporated Administrative Agencies（Act No．103 of 1999））．
 （2）Temporary members shall be appointed by the Minister of Education，Culture，Sports，Science and Technology from among persons with relevant knowledge and experience of special matters（or from among Foreign Nationals，where applicable，with in-depth knowledge and experience of special matters relating to research and development）．
 （3）Expert members shall be appointed by the Minister of Education，Culture，Sports，Science and Technology from among persons with relevant knowledge and experience of professional matters（or from among Foreign Nationals，where applicable，with in-depth knowledge and experience of professional matters relating to research and development）．

 （Term of Office of Committee Members）
Article 3（1）The term of an office for a Committee member shall be two years；provided，however，that the term of an office for a Committee member appointed to fill a vacancy shall be the remaining period of the successor’s term．
（2）Committee members may be reappointed．
（3）Temporary members shall be dismissed upon conclusion of the investigation and deliberation on special matters for which such members were appointed．
（4）Expert members shall be dismissed upon conclusion of the investigation on professional matters for which such members were appointed．
（5）Committee members，temporary members and expert members shall serve on a part-time basis．

（Council Chairman）
Article 4（1）The Council has a chairman who is elected from and by Committee members（except members who are Foreign Nationals）．
（2）The Council Chairman presides over the operation of the Council and represents the Council．
（3）If the Council Chairman is unable to attend to their duties，a Committee member（except members who are Foreign Nationals），who has been designated from and among Committee members by the Council Chairman in advance，shall perform the duties of the Council Chairman on their behalf．

（Sub-Committees）
Article 5（1）The Council may，pursuant to the provisions of the same，establish Sub-Committees．
（2）The Council Chairman shall appoint Committee members and／or temporary／expert members to be assigned to Sub-Committees．
（3）A Sub-Committee has a chairman who is elected from and by Committee Members belonging to the Sub-Committee（except members who are Foreign Nationals）．
（4）The Sub-Committees Chairman shall have authority over Sub-Committee operations．
（5）If a Sub-Committee Chairman is unable to attend to their duties，a Committee member belonging to the Sub-Committee（except members who are Foreign Nationals），who has been designated by the Sub-Committee Chairman in advance，shall perform the duties of the Sub-Committee Chairman on their behalf．
（6）The Council may，pursuant to the provisions of the same，make a resolution of the Sub-Committees a resolution of the Council．

（Proceedings）
Article 6（1）The Council shall hold a meeting and，when making a resolution，ensure the following requirements are met：
    1）The total number of Foreign National Committee members and temporary Foreign National members related to the proceedings should not exceed one fifth of the total number of Committee members and temporary members related to the proceedings；
    2）The majority of Committee members and temporary members related to the proceedings must attend．
（2）Proceedings of the Council shall be made by the majority of Committee members and temporary members related to the proceedings attending the meeting，and in the case of a tie，the Council Chairman shall make a decision．
（3）The provisions of the preceding two items shall apply mutatis mutandis to proceedings of Sub-Committees．

（Request for Submission of Materials）
Article 7 The Council may request that the head of the relevant administrative organ submit materials，express opinions，provide explanations and offer any other cooperation if it deems it necessary to carry out operations under its jurisdiction．

（Administrative Affairs）
Article 8 Administrative affairs of the Council shall be handled by the Planning and Evaluation Division under the Science and Technology Policy Bureau of the Ministry of Education，Culture，Sports，Science and Technology．

（Administration of the Council）
Article 9 In addition to what is provided in this Cabinet Order，the Council Chairman shall determine the procedures for the proceedings and other necessary administrative matters concerning the Council by consulting the Council．

Supplementary Provisions
This Cabinet Order shall come into force as of the day of promulgation．
