(3) Protection of cultural properties



1) The legal system for the protection of cultural properties

In the United States, the scope of protection for cultural properties was first limited to those which existed on land owned by the federal government. The scope of protection gradually widened, culminating in the National Historic Preservation Act of 1966, which exerted control over private properties. Concerning the protection of buried cultural properties, an amendment was made in 1974 to "An act to provide for the preservation of historical and archeological data (including relics and specimens) which might otherwise be lost as the result of the construction of a dam". It stipulated that all federal programs be preceded by measures for investigation or restoration of cultural' properties if they were in danger of destruction.


2) Organizations for the protection of cultural properties

The Department of the Interior's National Park Service and United States Fish and Wildlife Service, along with the Institute of Museum Services, are federal government organizations whose job it is to protect cultural properties. States also have their respective organizations for the protection of cultural properties. The Advisory Council on Historic Preservation is an advisory committee to the President, which offers advice on basic policies that involve the protection of cultural properties.

The National Trust for Protection of History, established by legislation in 1949, conserves and superintends important relics, maintains their custody and manages financial contributions and so on, for the purpose of carrying out federal policies for the protection of cultural properties and to promote the participation of the general public.
